The Government Is Weird

March 15, 2008

Have you ever downloaded stuff from websites, Limewire, Bearshare and torrent sites? Stuff that you most probably shouldn’t be downloading, stuff like albums, movies and copyrighted software? if yes, then you should be in jail now and you owe the government P100, 000. Yay!

According to the E-Commerce Law of the Philippines (enacted in 2001):

Piracy or the unauthorized copying, reproduction, dissemination, or distribution, importation, use, removal, alteration, substitution, modification, storage, uploading, downloading, communication, making available to the public, or broadcasting of protected material, electronic signature or copyrighted works including legally protected sound recording or phonograms or information material on protected works, through the use of telecommunication networks, such as, but not limited to, the internet, in a manner that infringes intellectual property rights shall be punished by a minimum fine of One Hundred Thousand pesos (P 100,000.00) and a maximum commensurate to the damage incurred and a mandatory imprisonment of six (6) months to three (3) years;

What do you think? I think the government should know how to make laws and know how to implement them.

So by that same rule, millions of local movies and tv shows should be paying royalties to the music they use, eh? Hmm I wonder how much they owe George Michael for his Careless Whisper.

They are paying royalties to the recording company who owns the publishing rights to the songs. In my opinion this law has no fangs and the actual sentence is pathetic compared to other countries.
